GENERAL TERMS AND CONDITIONS OF SALE GOODS AND PRODUCTS ON THE ONLINE SHOPPING SITE OF CELESTE PISENTI

These general conditions of sale regulate the sale to private consumers of luxury clothing items of the brand Celeste Pisenti and offered to its Customers through the website www.celestepisenti.com (hereinafter the "Site"), sold and distributed by Tessile Srl

1. INFORMATION ABOUT THE SELLING PARTY

For each transaction concluded through the Celeste Pisenti website, the selling party is Tessile srl (hereinafter the "Seller"), a company with its registered office in Italy in Rapallo (16035 - GE) in Corso Italia 36/6 , C.F. and P.IVA 02434610990, contactable by e-mail info@celestepisenti.com or e-mail PEC tessilesrl@cgn.legalmail.it

2. SCOPE OF APPLICATION

Tessile Srl sells and distributes Celeste Pisenti Products offered on the Site in Italy and worldwide to private consumers. The purchase of the Products includes the service of delivery of the order to the address indicated by the Customer through auxiliaries of Tessile srl . These Conditions of Sale apply to all and only purchases of Products made through the Site of Celeste Pisenti.

3. DESCRIPTION, CHARACTERISTICS INFORMATION ABOUT THE GOODS AND PRODUCTS

The description of the quality and characteristics of the clothing offered on the Site is made on the basis of information and documents made available by Tessile Srl. The photographs, videos, graphic or iconographic representations of the products, trade names or distinctive signs of any nature contained in the Site are intended to provide as much information as possible to the Customer about the Product. Before purchasing, the Customer is encouraged to carefully check the description and characteristics of the items of interest to him/her.

4. AVAILABILITY OF THE ITEMS

The goods and garments offered for sale on the Website are available at the Seller's stores and warehouses at the time they are selected and ordered. In the event that, due to chance or other reasons the item is no longer available after the order is placed, the Seller will contact the Customer by e-mail to notify the total or partial cancellation of the order and to proceed with the refund of the amount paid by the Customer and resolve the problem created.

5. PRICE OF THE PRODUCTS / TAXES AND SHIPPING AND INSURANCE / FREE DELIVERY

The price of the Products offered on the Website is the one indicated on the web page at the time of purchase by confirming and sending the order form.
In the event that a promotional campaign is active on some specific products, the price of the goods on the website will be indicated by showing the original retail price normally charged and crossed out and the reduced price valid for the time of the promotion.
In case the customer enjoys an individual discount code, the order form will show the original price before the application of the discount, indicated crossed out, then the individual discount or percentage discount, and finally the actual sale price for the customer.
In any case, Tessile Srl cannot be held responsible: (a) in the event that other sellers offer identical items at an original price different from or lower than the one practiced; (b) in the event of unintentional publication on the website of a price referring to a certain product that is manifestly lower than the one practiced on the market at the time of sale, when this amount is evidently too low in the eyes of an average consumer; (c) in the event of sales whose final amount appears to the average consumer to be manifestly wrong, when this error is due to technical errors.
The price of the product offered through the website: includes VAT and any other applicable taxes; but does not include the shipping costs of the Products until delivery.
Shipping costs are free of charge in Italy and at € 50.00 in the countries of the European Union. Shipping charges may vary depending on the delivery address, weight and volume of the goods and products. Before completing and finalizing the purchase, the Customer can check on the order form, the final purchase price with details: of any promotional discount granted, taxes due, shipping costs, with an indication of the final price due and actual to be paid.

6. FORMALIZATION OF ORDERS AND PURCHASE OF PRODUCTS

The purchase of Products through the Site is finalized by the Customer by confirming the order, following the guided procedure activated with the "Checkout" button.

Before proceeding to the purchase of Products by confirming the order form, the Customer is required to carefully read the general conditions of sale and conditions of use, which he/she may also print or store. By submitting the order form, the Customer declares that he/she understands and approves the contents of the order form, as well as accepts the general conditions of sale and use of the Site.

The purchase of the Product shall be deemed completed when the Seller receives payment of the price.

7. DELIVERY OF PRODUCTS

The Seller entrusts the delivery of the Products to DHL Express Courier. DHL allows the Customer the tracking of the shipment through its own service and the use of the tracking number, which the Seller can 'communicate to the Customer by e-mail, after the delivery of the package to the courier.

The order will be delivered to the address indicated by the customer in the delivery terms indicated by the courier and, in any case, within three (3) / five (5) working days from the date of delivery of the package to the courier, unless otherwise notified .

Delivery shall be deemed to have been made when the purchased goods are made available to the customer, or other third party designated by the customer / cohabitant, at the place of delivery indicated by the same.

The Seller undertakes to deliver the purchased items in perfect condition to the address indicated by the Customer in the order form at the time of purchase. The address may not be a post office box or zip code.

The address given by the Customer must be an address at which delivery can be made during normal business hours. If the customer (or other authorized person) is not present when the products are delivered to the given address, the courier will contact the customer indicating the procedure for arranging a new delivery. DHL may inform the recipient of an incoming shipment or non-delivery. Alternative options of a second delivery on a different day, or at a DHL Service Point, may be made available to the recipient. If after the second attempted delivery, the Customer has not contacted the courier, the goods will be returned to Tessile Srl's warehouses. In this case, Tessile Srl will reimburse only the price of the items purchased to the customer and the customer must bear the shipping costs and return costs as well as any related insurance costs of the goods shipped.

In the event that, after the delivery of the Products, the Customer finds that the packaging is ruined or, once the packaging is opened, that the Products are damaged in transit, or different from those ordered or, again, that some items related to the same order are missing, the Customer must notify the Seller as soon as possible and, if possible, within 5 days of delivery to allow it to report the defect to the carrier and to provide for the immediate replacement of the goods, if possible, or to reimburse the Customer for the payment made, in accordance with applicable law. In particular, Customer is requested to refuse delivery if the packaging does not have the sealing straps or has tampered straps.

8. WITHDRAWAL AND RETURN OF PRODUCTS / REFUND

Right of Withdrawal : The customer has the right to communicate withdrawal, in whole or in part, and to return the purchased clothing items, within fourteen (14) days from the date of delivery, the said items must then be returned to our premises no later than the fourteenth day, after which the return will not be accepted and the goods sent back to the sender at the sender's expense.
The unregistered user proceeds with the notice of withdrawal and return by sending an e-mail to ordini@celestepisenti.com with the subject line "Order withdrawal" indicating the item(s) he/she intends to return.

Once the notice of withdrawal has been received, the Seller will send an e-mail containing the data to be able to proceed with the return.
The Customer is free to communicate withdrawal and return the products at his or her own expense, as long as it is within the terms and manner prescribed by law. In this case, the Company warns the Customer that: (1) he/she will have to use a service with tracking or return receipt that must be communicated to the Seller; (2) the Seller will refuse the products returned by cash on delivery and/or freight; (3) the Seller will not be responsible in case of non-receipt of the products and in this case will not return the amounts collected.

In the event of withdrawal, the Customer shall be entitled to a refund of all payments made to the Seller excluding shipping costs provided that the Products are returned in the same condition in which they were delivered, have not been used and worn beyond mere testing, washed, damaged, stained, punctured, with pulled threads, with perfume or other odors that make it unsalvageable as new, removed from the packaging, or lost before return. The Seller will proceed with the refund due to the Customer, after the goods have been redelivered and as soon as the quality check procedures and listed items have been completed, all within and no later than 14 days unless closed for the summer and winter vacations, in which case at the first reopening.

Quality check. Because the Seller offers for sale through the Site luxury and high-value clothing items, it proceeds to check the quality condition of the garment before making refunds on returned Products. The Product must be in the same condition as it was delivered, with the original packaging and labels. Removal of the garment's label is considered unqualified acceptance of the item and, any return of a garment deprived of the labels, since it is no longer saleable, does not allow the right to a refund. The customer must return the product in the same package in which he received it complete in all its parts : in the event that the Product is not sent in the original packaging may be subject to devaluation chargeable to customer. In the return package .

Once the quality check is completed, the Seller will send the customer an email confirming receipt, with the details of the refund and will proceed to credit within 24 hours. The actual crediting of the refund due to the customer's account or card depends on the timing of the credit institution or issuer.

Return of defective products The Customer will still be entitled to a refund of all payments made to Tessile Srl for the return of defective products or products delivered that do not correspond to the order placed by the customer.

9.EXCLUSIVITY, MODIFICATION AND VALIDITY OF THE CONDITIONS OF SALE

These Terms and Conditions of Sale as published and accepted at the time of purchase by the user and / or at the time of registration by the Customer, govern exclusively and specifically each purchase made between Tessile Srl and users through the Site and supersede any other agreement or contract, verbal or written, even concluded previously between the parties. These Conditions of Sale do not apply to any other form of online or e-mail sales.

The Seller reserves the right to modify, at any time and without notice, the General Conditions of Sale, subject to compliance with the relevant legislation in force. Users always have at their disposal the General Terms and Conditions of Sale in force on the Site.

The possible nullity or ineffectiveness of any clause of these General Terms and Conditions of Sale does not entail the nullity of the other clauses or of the contract. The failure of Tessile Srl to exercise any right arising from these General Terms and Conditions of Sale shall not be construed as a waiver of such right, unless expressly waived in writing by Tessile Srl or the right and action are time-barred.

The General Terms and Conditions of Sale are also translated into German and English. In case of doubt as to the interpretation and application of the clauses, the Italian text shall prevail.

10. APPLICABLE LAW AND PLACE OF JURISDICTION

These Terms and Conditions of Sale are governed by Italian law in accordance with the European Directives on e-commerce and contracts concluded at a distance. In the event of disputes or litigation arising from the purchase of Products through the Site or from the application of these General Terms and Conditions of Sale and for the resolution of any conflict, the Seller and the Customer/User shall be subject to the jurisdiction of the court of the city where the consumer has his/her habitual residence or domicile. For the purposes of these General Terms and Conditions of Sale, a "consumer" is any natural person acting for purposes unrelated to his or her business, trade, craft or professional activity, if any, within the meaning of Article 2 Dir. 2011/83UE.
